What is a lasting power of attorney (LPA)?
A Lasting Power of Attorney (LPA) is a legal document that allows you (the Donor) to choose someone you trust, known as your Attorney, to make decisions for you if there ever comes a time when you are unable to make them yourself.
It is an important way to stay in control and to ensure that your wishes will be respected and carried out by those who understand you best.
There are two types of LPA, and many people choose to have both in place.
Health and Welfare LPA
A Health and Welfare LPA allows your chosen Attorney to make decisions about your personal health, wellbeing, and care, including:
- Giving or refusing consent to medical treatment
- Deciding whether you remain in your own home or move into residential care
- Choosing the right care home for you
- Making everyday decisions such as your meals, clothing, or daily routine
This type of LPA can only be used once you have lost the capacity to make these decisions yourself.
Property and Financial Affairs LPA
A Property and Financial Affairs LPA gives your chosen Attorney the authority to make decisions about your money and property, such as:
- Buying or selling your home
- Managing your bank or building society accounts
- Paying bills and expenses
- Claiming and using your pensions, benefits, or allowances
This LPA can be used while you still have capacity (with your permission), as well as if you lose capacity in the future.
Both types of LPA work together to ensure that every aspect of your life, from your finances to your personal care, is managed with care and in accordance with your wishes.
